| Abstract: | Шляхом порівняльного аналізу встановлюються особливості конституцій держав африканського континенту. Автор доходить висновку про розподіл основних законів на три групи за їх відношенням до проголошення прав людини й громадянина та їх захисту. До першої групи входять конституції, які, взагалі не маючи розділів про права людини, виголошують лише прихильність до зафіксованих у французькій декларації 1789 р. та Декларації ООН 10 грудня 1948 р. прав. Другій групі конституцій властивий стислий перелік прав, а третій - досить розлогий виклад змісту кожного із прав, що нагадує цивільні кодекси країн інших континентів. |
| Description: | By means of the comparative analysis features of constitutions of the states of the African continent are defined. The author comes to a conclusion about division of basic laws into three groups on their relation to declaration of human rights and their protection. The first group includes constitutions which, at all without having sections on human rights, proclaim only the commitment 1789 recorded in the French Declaration and the UN Declaration on December 10, 1948 to the rights. The squeezed transfer of the rights, and the third – rather widespread statement of the maintenance of each of the rights that reminds civil codes of the countries of other continents is peculiar to the second group of constitutions. |
