| Abstract: | Статья посвящена проблеме исследования признаков и условий правомерности использования средств самозащиты права собственности. Впервые проведено глубокое исследование признаков, при наличии которых самозащита этого права будет правомерной. Условия правомерности выведены вследствие анализа норм гражданского законодательства Украины, их структуры и конкретной практики их применения. Проведено сравнение соответствующих норм гражданского, уголовного права и норм Кодекса Украины об административных правонарушениях. |
| Description: | The article is devoted to the problem of research of signs and necessary conditions of legitimacy of the use of means of self-defense of right of own. Deep research of signs at presence of which the self-defense of right of own will have a legitimate character is first conducted. The necessary conditions of legitimacy are shown out as a cause of deep analysis of norms of civil legislation of Ukraine, their structure and concrete practice of their application. Comparison of the proper norms of criminal, civil law and norms of code of Ukraine of administrative offences is conducted in the article. |
