| Abstract: | У статті розглянуто теоретико-правові засади розвитку системи права України на сучасному етапі функціонування правової системи. Зокрема, вивчено питання, пов’язані з необхідністю виокремлення нових галузей права. Акцентовано увагу на науковій дискусії з приводу вторинних утворень у системі права та досліджено допустимість застосування теоретико-правової категорії «комплексна галузь права» на прикладі аграрного права України. В статье рассмотрены теоретико-правовые аспекты развития системы права Украины на современном этапе функционирования правовой системы. В связи с этим, в частности, изучены вопросы, связанные с необходимостью выделения новых отраслей права. Акцентировано внимание на научной дискуссии касаемо вторичных образований в структуре права, а также исследована возможность применения теоретико-правовой категории «комплексная отрасль права» на примере аграрного права Украины. |
| Description: | Paper we study the legal foundations for the development of the system of law in Ukraine. There for restudied legal science achievement in the field of scientific problems, which rises. Also investigated the views of the different schools of law that the reis a system of law and its structure. The study found that when the structure of the system created the concept of law, it was not the same a sin modern science. In the development of scientific view sit has changed significantly. And modern jurisprudence sees another meaning in terms that were formulated before. This is one of the main reasons for the discussions in the study of law. The article explores current issues about the need for new areas of law. These issues are also not new to the theory of law. Science formulated several clear grounds that give the opportunity to talk about what a particular group of the law is the branch of law. But alas, despite this debate continues. This process is clear and quite understandable, because it is caused by complex social processes of rapprochement between states and their legal systems. Resulting in modern science are often mixed fundamentally different phenomena, which is a system of law and legislation system. Article draws attention to the so called complex field of law. Investigate the possibility of using this concept in science, as well as the content of such concepts. Concluded that the legal framework does contain some secondary elements. In essence they do not create any separate system for regulating social relations. Yes, they stand out, but its only purpose of regulation. While they consist of other branches of law rules. So there is no reason to assume that these secondary elements separate elements of the system of law. Study conducted on the example of the agrarian law of Ukraine. |
