| Abstract: | У статті здійснене загальнотеоретичне дослідження поняття «принцип» з метою встановлення його значення та відмежування принципів від подібних до нього явищ, що сприятиме розумінню та застосуванню принципів у праві. У зв’язку з цим було проаналізоване співвідношення принципу з ідеєю, положенням, вимогою, стандартом, цінністю й ознакою. Зміст терміна «принцип» був установлений за допомогою лінгвістичного аналізу, а в етимологічному аспекті простежена генеза цього поняття. В статье осуществлено общетеоретическое исследование понятия «принцип» с целью установления его значения и отграничения принципов от схожих с ними явлений, что будет способствовать пониманию и применению принципов в праве. В связи с этим было проанализировано соотношение принципа с идеей, положением, требованием, стандартом, ценностью и признаком. Содержание термина «принцип» было установлено посредством лингвистического анализа, а в этимологическом аспекте прослежен генезис этого понятия. |
| Description: | In the article the general theoretic research of concept «principle» is carried out with the purpose of establishment of its value and delimitation of principles from the similar with them phenomena that will be conductive to their understanding and application in the law. In this regard content of term «principle» was set by means of linguistic analysis, and genesis of this concept is traced in an etymologic aspect. So, it is found out that principle come from Latin «principium» that is literally translated as began. Determining for understanding of this term is a reference to the word «prince». Also correlation of principle was analyzed with the followings contiguous categories: by an idea, position, requirement, standard, value and sign. It is at once noted thus, that principle is not simply position, idea, requirement, value, standard, and it is a substantive, fundamental, initial, general, leading position, requirement etc. So, the cornerstone of each principle is a certain idea which reflects its genetic aspect, because helps to demonstrate that principle is the intellectual-spiritual phenomenon, is the generation of human consciousness and provides with principles such characteristic as self-evidence, self-sufficiency. A word «position» means a thesis, assertion, being in basis anything and shows fundamental, constituent character of principles. A requirement is a request, obligatory for execution. Exactly principle connection with a requirement allows to reflect its as the imperative, categorical phenomenon. Every principle is value, but not on the contrary. They differ on the source of origin and mechanism of the appearance. A standard is understood as a model, cliché. Thus, standards are the principles, which attained a condition of most obligatoryness, regulated, fixing. But to differ they can on a form the expression and on the volume. It is also necessary to distinguish principles from signs. It seems that the last establishes that is characteristic to the phenomenon, object or process, demonstrates its essence and has no addresses or requirements to the subject. And the principle is the imperative phenomenon and fixes not that is, and how has to be. |
