В статье исследуются международно-правовые стандарты принципа независимости адвокатской деятельности, проблемы взаимоотношений адвокатуры с органами государственной власти, выявляются тенденции развития этих отношений в условиях построения правового государства и гражданского общества в Украине. |
| Описание: | The article investigates the problem of the relationship of advocacy with state power, identifies trends in the development of these relations from the standpoint of the cri- terion of independence of the legal profession and the development of democratic foundations of self-government. The article examines the problem of determining the place and role of advocacy in society, questions of admissibility of state intervention in the activities of advocacy and the possible types of such intervention. The public authorities and the legal profession must build a relationship based only on partnership the author concludes. In the article the principles of the relationship, as well as changes in the existing legislation governing the organization of work of Advocacy of Ukraine, guarantees of professional activities of advocacy. The advocacy in any civilized society is the only professional human rights institution that can effectively monitor the activities of the state through the implementation of its duties - protecting the rights and freedoms of citizens. The author proposes specific changes to the legislation on the Advocacy of Ukraine which regulates relations between the institution and the state, the principles of these relations. |
