| Abstract: | Статтю присвячено дослідженню найбільш поширеної форми державної зради в Україні з моменту початку російської агресії у 2014р. Піддано аналізу об’єктивні та суб’єктивні ознаки надання допомоги в проведенні підривної діяльності проти України. Виявлено проблемні питання кваліфікації та надано пропозиції, що спрямовані на вирішення проблем практичного застосування положень ст. 111 КК України щодо цієї форми державної зради. В статті піддано вивченню доступну судову практику за 2014-2018рр. Статья посвящена исследованию наиболее распространенной формы государственной измены в Украине с момента начала российской агрессии в 2014 г. Проанализированы объективные и субъективные признаки оказания помощи в проведении подрывной деятельности против Украины. Выявлены проблемные вопросы квалификации и сформулированы предложения, направленные на решение проблем практического применения положений ст. 111 УК Украины относительно этой формы государственной измены. В статье приводится доступная судебная практика за 2014-2018 гг. |
| Description: | The article was devoted to the study of the issue of provisioning of assistance a foreign state, a foreign organization or their representatives in carrying out subversive activities against Ukraine. It was determined that this form of state treason is the most widespread since the beginning of Russian aggression in 2014. The objective and subjective attributes of the crime were subjected to analysis. The definition of a crime subject, which is an optional feature, was proposed. Attention was drawn to the need to avoid competition art. 111 and art. 330 of the Criminal Code of Ukraine. The conclusion was made that this form of state treason is a special kind of aiding a foreign state, a foreign organization or their representatives. It is noted that this form of state treason is an actual problem because many convictions and the term «subversion» has appraisal nature that was used in art. 111 of the Criminal Code of Ukraine. The available judicial practice for 2014-2018 was subjected to study to find out the content this term. A simultaneous coexistence of the terms «subversion» in the Criminal Code of Ukraine and «exploratory subversive activities» in the legislation without disclosing their content was established. Solution to the issue of competition by leaving only one of these terms and fixing its features at the legislative level was proposed for harmonization of legislation. It was concluded that this crime was committed only with direct intent and special purpose – causing damage to sovereignty, territorial integrity and inviolability, state, economic or information security of Ukraine. It is determined that the crime is committed with the mercenary motive often. The problem issues of qualification were revealed and proposals were made, which directed at solving problems of practical application of the provisions of art. 111 of the Criminal Code of Ukraine regarding this form of treason. |
