| Abstract: | У статті на підставі наскрізної природи досліджуються особливості публічних закликів та розповсюдження матеріалів із закликами як особливих видів злочинів. Встановлено, що вони мають самостійний характер. Публічні заклики та розповсюдження матеріалів із закликами до вчинення відповідних діянь вирізняються істотними особливостями, обумовленими інформаційною природою та характером суспільної небезпечності. У разі повної реалізації умислу суб’єкта таких інформаційних дій, що полягає в доведенні до відома адресатів інформації з відповідним змістом, істотна шкода охоронюваним цінностям не заподіюється. Факт такого повідомлення навіть не створює реальну можливість заподіяння такої шкода. Ця можливість буде опосередкована можливими діяннями інших осіб. Ці інформаційні дії повинні мати очевидно менш суворий ступінь їх караності в порівнянні з відповідними злочинними діяннями. |
| Description: | Based on the cross-cutting nature, the article explores the features of public calls and the distribution of materials with calls as special types of crimes. It is established that they have an independent character. Public calls and the distribution of materials with calls to appropriate actions are distinguished by significant features due to the informational nature and nature of public danger. If the subject of such information actions fully implements intent, significant harm to protected values is not caused. The fact of notifying the public does not even create a real possibility of causing such harm. The opportunity will be mediated by the possible actions of others. These informational actions should have an obviously less severe degree of punishability in comparison with the corresponding criminal acts. |
