| Abstract: | Стаття присвячена дослідженню проблем дискримінації пацієнтів у сфері охорони здоров'я. Визначено підстави для дискримінації у цій сфері та виявлено найбільш нагальні. Значна увага була приділена досвіду України в правовому регулюванні питання. Що стосується України, то найбільш проблемними питаннями є дискримінація пацієнтів на основі сексуальної орієнтації та місця проживання. У запобіганні дискримінації важливу роль відіграють міжнародні акти. Найбільш важливим міжнародним документом щодо захисту прав особи є Європейська конвенція з прав людини. Але міжнародні правила не мають спеціальних правил, які б забороняли дискримінацію у секторі охорони здоров'я. Такі положення будуть відображені в національному законодавстві. Як результат, у статті були внесені практичні пропозиції до законодавства. |
| Description: | The article in an investigation of problems of patient discrimination in the sphere of health protection. Grounds for discrimination in this sphere were identified and the most urgent ones detected. Significant attention was paid to the experience of Ukraine in legal regulation of the issue. As for Ukraine, the most problematic matters are discrimination of patients on the basis of sexual orientation and place of residence. In prevention of discrimination an important role is played by international acts. The most important international document, in terms of protecting individual rights, is the European Convention on Human Rights. But international regulations have no specific rules that would prohibit discrimination in the health sector. Such provisions would be reflected in the national legislation. As a result, in the article, there were made practical propositions to the legislation. |
