| Abstract: | У статті досліджуються питання поняття юридичної природи актів органів і посадових осіб місцевого самоврядування як джерел муніципального права. Виокремлюються їх особливості в системі правового регулювання муніципально-правових відносин, а також перспективи розвитку цього рівня регулювання суспільних відносин у сфері місцевого самоврядування. Зроблено акцент на тому, що будучи актами громадських утворень, яким є муніципальні структури, вони набувають правовий характер шляхом використання правової форми діяльності, універсальний для усіх інститутів публічної влади. Аналіз юридичних характеристик джерел муніципального права (загальнообов'язковість, нормативність, територіальність, забезпечення державним примусом) дозволяє розкрити їх особливості в системі джерел муніципального права. |
| Description: | The article examines the question of the concept of the legal nature of acts of bodies and officials of local self-government as sources of municipal law. Stand their features in the system of legal regulation of the municipal legal relations, as well as the prospects for the development of this level of regulation of social relations in the sphere of local self-government. Emphasis on the fact that as acts of public creation, which is what municipal structures, they acquire through the use of a legal nature of the legal form of activity is universal for all institutions of public power. Analysis of the legal characteristics of the sources of municipal law (universally binding, regulatory, territoriality, providing state coercion) can reveal their features in the system of sources of municipal law. |
