| Abstract: | Стаття присвячена визначенню підходів до законодавчого врегулювання правового статусу міських агломерацій в Україні та створюваної у їх межах системно-структурної організації місцевого самоврядування. Досліджуються існуючий стан вітчизняної правової політики у сфері функціонування міських агломерацій, моделі правового статусу агломерацій у зарубіжних країнах, можливі напрями правової інституціоналізації міських агломерацій в Україні та законодавчого регулювання створюваної системи муніципального управління. Окрема увага присвячена аналізу проекту Закону України «Про міські агломерації» (реєстр. № 6743 від 17.07.2017р.). |
| Description: | The article is devoted to the determination of approaches to the legislative regulation of the urban agglomerations legal status in Ukraine and to the system structural organization of local self-government created within them. It is pointed out that in the globalized world agglomerations become points of economic growth and concentration of competitiveness, as well as centers of administrative and social services of the population. This determines the necessity of special attention of the state to the formation of the legal space for their functioning and to the construction of an effective system of governance at the local level. The legal policy of Ukraine in the field of urban agglomerations functioning cannot be considered as satisfactory. Indeed, despite of the rather thorough and comprehensive elaboration of the economic, geographic, and urban aspects of these entities, Ukrainian legislation not only does not institutionalize urban agglomerations, but also almost does not use this notion in the modern legislation. The main provisions of the draft Law of Ukraine “On Urban Agglomerations” (reg. № 6743 dated 17.07.2017) are revealed and critically assessed in the article, emphasizing their problematic aspects. |
