| Abstract: | Стаття присвячена одній із актуальних проблем конституційного і муніципального права. Місцеве самоврядування в сучасних умовах не може існувати поза сферою певних загальних нормативних вимог (принципів), що відповідають природі національної державності, загальнолюдським цінностям і демократичним ідеалам. Сучасні принципи й форми місцевого самоврядування – результат складного процесу пошуку компромісу, узгодження інтересів суспільства в особі територіальних співтовариств і держави, що безпосередньо пов’язано з дієвістю публічної влади, раціональністю її системно-структурної організації, оптимальністю розподілу повноважень і відповідно матеріально-фінансових можливостей між державною і муніципальною владою. Статья посвящена одной из актуальных проблем конституционного и муниципального права. Местное самоуправление не может существовать в современных условиях вне сферы определенных нормативных требований (принципов), отвечающих национальной государственности, общечеловеческим ценностям, и демократическим идеалам. Современные принципы и формы местного самоуправления – результат сложного процесса поиска компромисса в лице территориальных объединений и государства, который непосредственно связан с эффективностью публичной власти, рациональностью и ее системно-структурной организацией. |
| Description: | Article is devoted to one of actual problems of the constitutional and municipal right. The local government can nоt exist in modern conditions to not spheres of certain standard requirements (principles) which answer national statehood, universal values, and democratic ideals. The modern principles and forms of local government – result of difficult process of search of a compromise in the person of territorial associations and the state which is directly connected with efficiency of the public power, rationality, and its system and structural organization. This work is devoted to the question of the essence of the principles of local government. Unfortunately, this issue has recently not been paid sufficient attention, especially in terms of the latest trends in globalization. Due to the high dynamics of the process of constitutional development in Ukraine, insufficient analysis of the aforementioned issues is an obstacle to the solution of many derivative problems caused by the realities of the present constitutional system of the entire municipal law. An objective conditionality that envisages their accordance of character and to existent development of public relations status comes forward as an important sign of principles of local self-government, and also economic, to the ideological processes really existing in society. Principles have constituent character, ides called to create terms for functioning and development of all subjects of local self-government. They integrate, unite and do possible existence of other municipally legal institutes. |
