| Abstract: | У статті досліджено практики лобіювання, що склалися в політичному процесі країн сучасного світу та України. Лобізм представлено як систему і практику реалізації інтересів різних соціальних груп, спілок, асоціацій громадян, субстрат і субеліт, бізнес-груп і корпорацій. Узагальнено соціальні функції лобі: соціальне по середництво; сприяння обміну інформацією; вплив на рішення державної влади; агрегація та раціоналізація суспільних очікувань. Проаналізовано суттєві риси і практики, які відрізняють плюралістичне, корпоративістське лобі та ін.; виявлено їх суперечливі характеристики. Здійснено оцінку світового досвіду законодавчого врегулювання лобістської діяльності, визначено тенденції і перспективи соціально-правового розвитку лобізму в Україні. В статье исследуются практики лоббирования, сложившиеся в политическом процессе государств современного мира и Украины. Лоббизм представлен как система и практика реализации интересов социальных групп, союзов, ассоциаций граждан, субстрат и субэлит, бизнес-групп и корпораций. Обобщены социальные функции лобби: социальное посредничество; содействие обмену информацией; влияние на решения власти; агрегация и рационализация общественных ожиданий. Проанализированы сущностные черты и практики, которые отличают плюралистическое, корпоративистское лобби и пр., выявлены их противоречивые характеристики. Проводится оценка мирового опыта законодательного урегулирования лоббистской деятельности, определены тенденции и перспективы социально-правового развития лоббизма в Украине. |
| Description: | In the article practices are probed lobbying, folded in the political process of the states of the modern world and Ukraine. Indisputably, lobbyism is an effective mechanism of civil society, consequently he must be «satellite of democracy». Lobby is presented as a system and practice of realization of interests of task forces, unions, associations of citizens, substrates and subelites, business-groups and corporations. The sociologists of policy A. Bentli and Zh. Meyno considered a specific line of lobby – practical absence of legal regulation of activity. The social functions of lobby are generalized: social mediation; assistance an exchange by information; influence on the decisions of power; consolidation and rationalization of public expectations. Modern process of lobbying usually technologically carries out small group of people, that is why in practice there are risks of abuses through mercenary, narrowly group interests. A main value of lobbyism is creation of legitimate possibility of participation of the «interested» groups in development and acceptance of state decisions with bringing in of competent specialists. Essence lines and practices which distinguish pluralistic, corporate lobby and others are analysed, their contradictory descriptions are exposed. In relation to the higher echelons of power of group of pressure carry out the legislative, executive and judicial lobbying. Of a particular branch lobbying takes a place at the level of ministries, departments, state committees, departments. Local authorities quite often operate as lobbyists, obtaining in a fight necessary regions (to societies) advantages, subsidies or privileges – is the regional lobbying. Socially-legal potential of lobbyism: he complements the constitutional system of democratic representative office, allows to influence on acceptance and realization of political decisions those groups of societies, which are deprived possibility to articulate own interests through deputies. Practices of national lobbyism must be expressly legally regulated, instrumental in providing of publicity and progress in a political process. The estimation of world experience of legislative settlement of lobbyist activity is conducted, tendencies and prospects of socially-legal development of lobbyism are certain in Ukraine. At the terms of development of democracy of lobby in Ukraine must an actual prospect grow into a necessary socio-political institute. |
