Abstract: У статті розглянуто конституційні механізми гарантування державного суверенітету держав-членів ЄС. Проаналізовано нормативні (конституційні та міжнародно-правові) особливості входження різних країн до Європейського Союзу. Так, якщо держави-засновники Євросоюзу (Франція та Німеччина) ухвалили низку норм (розділ) про засади своїх відносин з Європейським Союзом, то нові держави-члени можуть вдатися до застосування так званого «європейського застереження», за яким до їх конституцій можуть включатися статті про засади їх входження до міждержавних об’єднань.
В статье рассмотрены механизмы гарантирования государственного суверенитета государств-членов ЕС. Проанализировано нормативные (конституционные и международно-правовые) особенности вступления разных стран в Европейский Союз. Так, если государства-основатели Евросоюза (Франция и Германия) учредили ряд норм (раздел) об основах своих отношений с Европейским Союзом, то новые государства-члены могут прибегнуть к так называемой «европейской оговорки», при которой в их конституции могут быть внесены статьи об основах их вступления в межгосударственные объединения.
Description: The article deals with the constitutional mechanism which guarantees the state sovereignty of the EU member states. Normative (constitutional and international) peculiarities for various countries to join the European Union have been analyzed. If the founding states of the European States (France and Germany) adopted a lot of norms on the fundamentals of their relations with the European Union, new member-states (such countries as Poland, Czech Republic, Hungary, Slovakia, Slovenia, Latvia, Lithuania, Cyprus, Malta which joined the EU in 2004 (the fifth enlargement)) can refer to the European clause, under which new articles on the fundamentals of joining interstate unions can be included in their constitutions. But such “European Clause” was dealt with as a guarantee of the state sovereignty. It is understood as an accession related to the participation of sovereign state in the supranational unions when the Basic Law is amended by one or two articles which regulate the issue of joining interstate unions. It has been proposed to apply this method for Ukraine in order to resolve some issues. Integration processes in Ukraine to join the European Union require harmonization of the national legislation with the European law. It is caused by the fact that the further result of integration of Ukraine into interstate unions depends on the effective mechanism of constitutional ensuring, respective policy towards both domestic and foreign public order. the Journal of Eastern European Law / Журнал східноєвропейського права. – 2015. – № 20. ISSN 2409-6415 41 At the same time it has been proved that the European legal standards play an important role in these processes, particularly the recognized principles of law which are based on sovereignty and democracy. All these factors influence significantly on qualitative and quantitative features of sovereignty of any state and contribute to the topicality of their research.
