| Abstract: | В работе анализируются проблемы защиты прав и интересов кредиторов наследодателя по гражданскому законодательству Украины и Российской Федерации. Исследуются особенности осуществления кредиторами прав на предъявление претензий к наследникам по обязательствам наследодателя. С учетом материалов судебной практики рассматриваются возможности использования кредиторами исков о защите обязательственных прав. |
| Description: | This paper analyzes the problem of protecting the rights and interests of creditors of the testator under the civil legislation of Ukraine and the Russian Federation. Investigated the features implementation of creditors the rights to file claims against the heirs on obligations of the testator. Given the materials jurisprudence considered an opportunity to use creditors the lawsuit on protection of liability rights. |
