| Аннотация: | Стаття присвячена розгляду окремих норм Кримінального і Кримінально-виконавчого кодексу України, які регулюють порядок застосування до засуджених умовно-дострокового звільнення. Автор дає власне бачення і висновок про правову природу, сутність, логіку побудови і правові ситуації, на які розраховані ч. 5 ст. 82 КК України і ч. 8 ст. 154 КВК України, з’ясовує чи мають ці норми колізійну природу або ж йдеться про різні правовідносини. Статья посвящена рассмотрению отдельных норм Уголовного и Уголовно-исполнительного кодексов Украины, которые регулируют порядок применения к осужденным условно-досрочного освобождения. Автор дает собственное видение и формулирует вывод о правовой природе, сущности, логике построения и правовых ситуациях, на которые рассчитаны ч. 5 ст. 82 УК Украины и ч. 8 ст. 154 УИК Украины, выясняет имеют ли эти нормы коллизионную природу или же речь идет о разных правоотношениях. |
| Описание: | The article deals with issues regarding different implementation of p. 8 of Art. 154 of the Correctional Code of Ukraine and p. 4 of Art. 82 of the Criminal Code of Ukraine. These articles refer to the conditions of implementation of release on parole for those convicts against who replacement of punishment (or its part) with more lenient one was applied. Part 5 of Art. 82 of the Criminal Code defines that parole on release can be applied to those persons against who the punishment was replaced with more lenient one in accordance with the rules provided for by Art. 81 of the Criminal Code of Ukraine. Part 8 of Art. 154 of the Correctional Code states that persons who have been released on parole or released in accordance with the procedure of replacing unserved part of punishment with more lenient one if they were sent to prison or deprived of liberty in cases provided for by law can be presented again for release on parole or replacement of unserved part of punishment with more lenient one not earlier than one year following the decision on sending to prison. At the first glance these provisions are similar and specify each other. In this regard, there are numerous cases at the correctional bodies and institutions when the convict is refused to be presented to release on parole because from the day of imprisonment (after replacing the punishment with more lenient one) one year has not passed. Thus the purpose of this article is to analyze legal acts, scientific literature and legal practice which provide an opportunity to form an own opinion, interpretation and conclusion on legal nature, essence, logic of construction and legal situations which refer to p. 5 of Art. 82 of the Criminal Code of Ukraine and p. 8 of Art. the 154 of the Correctional Code of Ukraine as well as to find out whether there is a collision, conflict of laws or various legal relations. |
