| dc.description | This article deals with the features of the opening of criminal proceedings as part of the methodology of investigation of violations of safety rules during the execution of works with high risk based on the generalization of criminal cases (materials of criminal proceedings). The relevance of this research is confirmed by statistical indicators of the State Service of Mining Supervision and Industrial Safety of Ukraine, according to which 1808 cases of injuries, of which 107 – fatal were registered for first three months of 2014 in Ukraine total on enterprises. The proceedings by violation of safety rules during the execution of works with high risk can be started on the basis of departmental inspection act, namely 95.8 % of criminal proceedings. But this basis is general and we can be classified it into: 1) notice of the availability of the offense in the manner of a routine inspection; 2) notice of availability of the offense in order investigation the accident.
