| dc.description | The theoretica1 and 1egis1ative problems of determining the plасе of crimina1 misconduct in the Ukrainian 1ega1 system are considered in the artic1e. Specia1 attention is given to foreign experience and nationa1 traditions, as well as the study of the positions of researchers in establishing the essence of the crimina1 misconduct and its plасе in the system of offenses. The attention is focused on the mandatory comp1iance with the Constitution of Ukraine with the introduction of new types of offenses. The ways of introducing а crimina1 wrongdoing in the crimina1 1aw, the re1evant provisions of the Basic Law of the State, inc1uding а minor offense with а minor degree of public danger are proposed. | en_US |
| dc.description.abstract | Статья посвящена рассмотрению теоретических и законодательных проблем определения места уголовного проступка в украинской правовой системе. Особое внимание уделяется зарубежному опыту и национальным традициям, а также изучению позиций исследователей в установлении сущности уголовного проступка и его места в системе правонарушений. Акцентируется внимание на обязательности соблюдения Конституции Украины при введении новых видов правонарушений. Предложены пути внедрения уголовного проступка в уголовное законодательство, соответствующие положениям Основного Закона государства, в том числе, такие как преступления небольшой тяжести с незначительной степенью общественной опасности. | en_US |
