| dc.description | The concept «the form of the state government» was generated in the course of political development and has been reflected in results of informative activity of many generations of philosophers and state researchers. The variety of sights concerning a definition of the form of government and the content at the present stage of development of jurisprudence shows gnoseological problematical character and an urgency of this question. Cognition of such state-legal phenomenon as «the form of the state government» can be carried out through a prism of philosophical categories, which it derives from. Such categories are «form» and «content», which reflect interrelation of two parties of natural and social reality. Number of variants of the laws characterizing interaction of the content and the form are underlined in the article: prevalence of the content over the form; relative stability of the form, its independence regarding the content; active role of the form in development of the content; contradiction constancy, struggle between form and content; content transition in the form and vice versa; plurality of forms of single content. «Form» and «content» are in organic unity with such pair categories as «essence» and «phenomenon». The content and essence are in constant development and, changing, cease to correspond to the existing traditional forms of government. It leads to necessity of allocation of the new form of government, formulation of a theoretical design, corresponding to it. Viability of the new form of government proves to be true by its distribution, an embodiment into the constitutional legislation and political-legal practice of the states of the world. Legal sociological approach to «form of government» is considered, according to which the form of government of each state has 2 sides – legal (formal, judicial), and political, directed at studying real historical life, which is a set of real volitional relations, found in political practice. It is revealed that despite variability of the political form, quality of which has been confirmed by sociopolitical practice, it should be studied in a direct connection with the legal form, because legal regulation of public relations appears more effective, when it precisely expresses real processes and requirements of development of society. Some points of view on the state form are analyzed in the article: widely as a way of governing and state system, narrowly – only as the form of government; as organizations of political power in it, taken in unity of 3 basic elements – the forms of government, state system and political regime. Definition of the form of government is made. It is thus noticed that the form of government should not necessarily include all volume of the organization of governing bodies, differentiate the competence between them, as it is offered sometimes, because it can lead to its identification with concept “the state mechanism”. The form of government is considered to be leading in the system of elements of the form of the modern state, and its structural elements are “all components of mechanism of government”. Positions of scientists concerning definition of the form of the state government are analyzed. The position is supported that it is possible to allocate the internal form – reflection of the content and essence of the state, external – reflection outside of its internal form. Thus the political regime carries out function of the internal form, and the form of government and a state system – external one. | en_US |
