| Abstract: | Стаття присвячена визначенню стану та перспектив правового забезпечення державного нагляду за додержанням органами місцевого самоврядування Конституції та законів України. В статті охарактеризовані конституційні вимоги та європейські стандарти державного нагляду за функціонуванням місцевого самоврядування. Розкривається оновлений механізм державного нагляду, передбачений проектом Закону України «Про внесення змін до Конституції України (щодо децентралізації влади)». Критично оцінюються підготовлені за дорученням Уряду України законопроекти про префектів, про зупинення актів органів місцевого самоврядування та інші. Формулюються авторські пропозиції щодо моделі законодавчого врегулювання організації та здійснення державного нагляду за законністю діяльності муніципальних органів. |
| Description: | The scientific article is devoted to the determination of the state and prospects of legal provision of state supervision over observance of the Constitution and laws of Ukraine by local self‑government bodies. The relevance of the problems is determined by the absence in Ukraine of an effective mechanism of state supervision over the legality of the activities of local self‑government bodies and the necessary legal basis for it. At the same time, the development of new draft law initiatives regarding the legal regulation of this sphere requires its generalization and critical analysis. The article describes the European standards of state supervision over the functioning of local self‑government determined by the European Charter of Local Self‑Government as well as the provision of Recommendations No. R (98) 12 «On Supervision of Local Authorities’ Action» adopted by the Committee of Ministers of the Council of Europe. At the same time, the authors ascertain that the existing legal and institutional mechanism of state supervision and control over the activities of municipal authorities is not in line with the European standards while substantiating the lack of a systematic appropriate legal framework of this mechanism. |
