dc.descriptionThe article deals with the organization and operation of the legal system of providing free legal aid in the European Union. The author analyzes the basic model of free legal aid, currently operating in the EU. The author investigates the system management issues of free legal aid, the main criteria for determination of person’s right to receive such assistance and other issues. On the basis of the conducted research the author comes to the conclusion that management of the subsidized legal aid system in the EU is carried out as a rule, by budgetary bodies, created mainly by the Ministry of Justice. In those countries where the system control is carried out by judiciary, such systems are relatively ineffective. Effectiveness of subsidized legal aid systems is achieved only when all the functions of its organization, control and coordination are concentrated on one body, which legal status peculiarity is its independence. Subsidy aid supposes investment of public funds into its implementation. However, the state budget may not be the only source of funding. The main criteria for establishment of person’s right to receive free (subsidized) legal aid in the EU are: 1) the interests of justice, 2) financial criteria (taking into account, for example, income or (and) property availability and some others). In practice there are three main approaches to the assessment of people’s property status, who apply for subsidized legal aid. Lawyers can be responsible for verification of information about a property status of the person who applies for such assistance. Sometimes as a reason for subsidized legal aid provision in the EU the concept of necessity of its provision “in the interests of justice” is used, but the study of these issues is a subject of another research.ru_RU
