| dc.description | The article investigates the guarantees of the confidentiality principle in advocacy in the law of the European Union and in Ukraine. The topic relevancy is due to the need for research of the European law in the framework of the integration processes, mutual rapprochement of the national legal systems, perfection of legal bases of cooperation between Ukraine and the European Union. The character, nature and essence of the attorney-client privilege are examined. Significant attention is paid to the legislative fixing of advocacy confidentiality guarantees in the international documents, in the sectoral legislation of the EU member countries, analysis of the decisions of the European human rights court. The author suggests improving of the legislation of Ukraine, which regulates the issues of the attorney-client privilege observance, aimed at adjusting national legislation to the European standards. It is proven that the additional guarantee of the confidentiality principle observance in the advocacy will be an obligation to obtain a judgment on the possibility of carrying out investigative actions against the lawyer; the need to establish mandatory witnesses participation during the search implementation in the lawyer's office, giving them the right to express their disagreements with the conduction of these investigative actions by entering them into the record of investigative actions, determination of certain requirements to these persons regarding their education, experience, place of work, and so on. The study used general scientific methods and special methods of cognition, in particular, a comparative-legal one. The conclusions of this work can be used in the learning process of law schools and faculties, and in the adoption of the new legislation that governs the advocacy. | ru_RU |
