| Abstract: | У статті розглянуто проблему латентності жорстокого поводження з тваринами в Україні. Наведено результати експертного опитування щодо обсягу та структури латентності жорстокого поводження з тваринами в Україні. Запропоновано перспективні напрями скорочення обсягів латентності досліджуваного феномену. В статье рассмотрена проблема латентности жестокого обращения с животными в Украине. Приведены результаты экспертного опроса относительно объема и структуры латентности жестокого обращения с животными в Украине. Предложены перспективные направления сокращения объемов латентности изучаемого феномена. |
| Description: | The article considers the problem of animal abuse latency. The results of questioning experts from the Association of the animal care organizations of Ukraine have been laid out. The author pays attention to the fact that according to 29.5% of experienced animal care volunteers, the ratio of detected and latent cases of animal abuse is 1:10,000, 26.2% chose option 1:15000 and another 19.7% stopped at a ratio of 1:5000. Therefore, the ‘dark figure’ of animal cruelty is about 99.9% of all committed crimes. As for the most latent forms of animal abuse, the respondents have predictably indicated zoos, circuses, dolphinariums, laboratories, farms and municipal institutions as the least revealed places of latent animal cruelty. The author offers to classify the reasons for the latency of animal abuse based on the classification of Valerii F. Obolentsev. The first impact factor is the absence of a personified injured party, thus committing the crime under Art. 299 of the Criminal Code of Ukraine without witnesses is not difficult to conceal at all. The second cause is the passive and sometimes even aggressive attitude of Ukrainian society towards the problem of straw animals and cruel treatment of animals on farms and for the research purposes. Another root is hidden in the shortcomings of Ukrainian legislation; according to the latter it is highly complicated to delimit the grounds of administrative and criminal liability for animal abuse. The last and, perhaps, the most significant cause for animal abuse latency is the lack of proficiency, corruption and the indiscipline of Ukrainian militia. In the end, the author offers the most prospective ways of animal abuse latency prevention. |
