| Abstract: | Розглянуто різні точки зору на ландшафт як об’єкт правового регулювання. Окреслено проблеми формування правового режиму ландшафтів в Україні. З урахуванням очевидності необхідності ретельного вивчення цього питання та внесення змін у законодавство щодо закріплення правового режиму ландшафтів. Підкреслено важливість адаптації правової системи України до законодавства ЄС та запозичення досвіду тих країн, в яких питання правового регулювання ландшафтів отримало більшого розвитку. Рассмотрены различные точки зрения на ландшафт как объект правового регулирования. Раскрыты проблемы формирования правового режима ландшафтов в Украине. С учётом очевидности необходимости тщательного изучения этого вопроса и внесения изменений в законодательство относительно закрепления правового режима ландшафтов. Подчёркнуто важность адаптации правовой системы Украины к законодательству ЕС и заимствования опыта тех стран, в которых вопросы правового регулирования ландшафтов получили большее развитие. |
| Description: | The article discusses different points of view on the landscape as a subject of legal regulation. It reveals the problems of forming of the legal regime of landscapes in Ukraine. Landscapes are important not only for preserving of the gene pool and maintaining the viability of the planet, but they also have irreplaceable aesthetic value. The author discusses aesthetic properties of landscapes. Recognition of these properties as objects of legal protection is one of the strategic directions towards the sustainable development, which should be reflected in the environmental legislation. The article deals with the concept and issues of landscape planning. The increasing of requirements for environmental protection in general, protection and rational use of landscapes, determine the need for updating the law. This is required by the harmonization process, the key element of which is the adaptation of the legal system of Ukraine to the Legislation of European Union. The European legislation contains various legal aspects of regulation of landscapes and involves their conservation primarily within the ecological network. Attention is focused on the provisions of the legislation on the ecological network of Ukraine, which are practically not realized, despite their extremely high potential for the protection of natural complexes and ecological systems and landscapes, as well as in the aspect of European integration. The author analyzes the legislation and concludes that landscape preservation legislation should include: 1) the legal definition and classification of landscapes; 2) the rights and responsibilities of subjects for the conservation, restoration, enhancement and usage of landscapes and compliance with the requirements of protection; 3) legal liability for violation of the legal regime of landscapes. It is obvious that there is a great need for careful study of the issue and amendments to legislation on fixing of the legal regime of landscapes. The author emphasizes the importance of borrowing practices of the countries in which the legal regulation of landscapes have received greater development. |
