| Abstract: | В статье проведено комплексное исследование правовых категорий и проблем, связанных с развитием системы принципов экологического права, воздействием на нее естественно-правовых концепций. Статья содержит комплексный анализ доктринальных, а также стратегических документов экологического законодательства Украины, на основе которого с учетом эмпирического и теоретического изучения нормативно-правовых актов вырабатываются предложения по его дальнейшему совершенствованию. На основании изучения достижений общей теории и экологического права доказывается нецелесообразность отождествления понятий «правовые экологические принципы», «принципы экологического права» и «принципы экологического законодательства», проводится их системное рассмотрение. В Украине сформировалась и продолжает совершенствоваться система принципов экологического права. Влияние на нее естественно-правовых подходов способствует правильному толкованию юридических норм, преодолению противоречий и пробелов в экологическом законодательстве, дальнейшей его кодификации. |
| Description: | In this article the comprehensive research of the legal categories and problems connected with the development of the system of the environmental law principles by the way of the natural-legal principles influence on it has been conducted. The article includes the complex analysis of the doctrinal and also strategic documents of the environmental legislation of Ukraine on the base of which, taking into account empirical and theoretical study of the normative-legal acts, proposals for its further improvement have been worked out. On the base of the achievements of the general theory and the environmental law study, inexpedience of identification of the notions such as: «legal environmental principles», «principles of the environmental law» and «principles of the environmental legislation» have been proved, their systematic consideration has been conducted. In Ukraine the system of the ecological law principles has been formed and this system continues to improve. The influence on it of the natural-law approaches contributes to the proper interpretation of the legal norms, overcoming of the contradictions and gaps in the ecological legislation and further its codification. |
