| Abstract: | В статье на основе историко-правового анализа исследуется становление судебной системы как социально-правового феномена. Автор приходит к выводу, что суд, как способ разрешения конфликтов, существовал с момента осознания человеком своей социальной природы. Возникновение же судебной системы стало возможным лишь после признания государством принципа разделения властей. |
| Description: | Formation of the judicial system as social-legal phenomenon is researched in article on base historian-legal analysis. The author comes to conclusion that court as way of decision of a conflict existed since moment of the realization of the person’s of social nature. Origin judicial system became possible only after confession of the principle of division of the powers by state. |
