| Abstract: | Статья посвящена проблемам финансовой деликтоспособности государства. Речь идет о невыполнении или ненадлежащем выполнении государством своих финансовых обязательств (бюджетных и долговых), определяются их особенности. Предлагается закрепить на уровне закона родовое понятие «финансовое обязательство государства» с видовым его делением на обязательство бюджетное и долговое, а также порядок применения юридической ответственности государства в случае их наступления. |
| Description: | The article is devoted to the problem of the state financial delictability. It means non-execution or improper execution by the state of its financial obligations. Such kinds of obligations as budget and debt obligations have been considered; their peculiarities have been determined. The securing at the legislative level of the patrimonial conception such as «state financial obligations» with their further specific division into «obligation» and «debt obligation» has been proposed; the order of the state legal liability in case of their coming will be worked out. |
