Юридична термінологія звичаєвого права (на матеріалах "Руської Правди")

Abstract

Статья посвящена исследованию юридической терминологии обычного права Киевской Руси. Рассматриваются пути формирования, образования и особенности развития юридической терминологии обычного права на материалах «Русской Правды» и других источников права того времени; дается сравнительно-правовая характеристика, анализируется соотношение источников и форм выражения наиболее распространенных юридических терминов обычного права, рассматриваются проблемы их толкования и правопонимания в целом.

The article is dedicated to the research of juridical terminology of common law of the Kiev Rus. In the context of the raised problem, the ways of formation, generation and the features of the juridical terminology's progress of common law on the materials of«Russian Truth» and on the other legal sources of that time are examined; law-comparatively description, correlation and theoretical analysis of the sources and of the most common juridical terms of common law's wordings are considered, the problems of their interpretation and in the lawunderstanding are also reviewed.
