| Abstract: | Стаття присвячена актуальним питанням сутності та співвідношення контролю та нагляду в органах публічної влади. Наводиться аналіз зазначених категорій, встановлюються їх ознаки, спільні та відмінні риси. Аналізуються різновиди та форми здійснення кожного з них. Зважаючи на обмежений обсяг наукових досліджень в цій сфері здійснено аналіз праць вчених, де наводиться визначення понять контролю та нагляду, а також законодавчих актів. Наводяться практичні організаційні моделі здійснення наглядової та контрольної діяльності з урахуванням тенденцій децентралізації влади. |
| Description: | The article is devoted to topical issues of the essence and correlation of control and supervision in public authorities. The analysis of the legislation on the subject of legal regulation of control and supervisory relations. It has been established that the Constitution of Ukraine does not contain separate provisions related to the control and supervisory activities of local self‑government. Analyzed the provisions of the European Charter of Local Self‑Government, which establishes administrative oversight of local selfgovernment. In this regard, an analysis of this concept was carried out, its legal characteristics and scope of application were established. Conclusions are drawn about the shortcomings of legal regulation of the issues of control and supervision, as well as the need to adopt changes to the Constitution of Ukraine in order to establish supervisory relations between state bodies and local self‑government. In this case, emphasis was placed on the need to take into account foreign experience when choosing a supervisory authority and establishing its legal status. |
