Abstract: Проаналізовано стан правового врегулювання порядку обчислення часу в Україні. Надано експертну оцінку на проект постанови Верховної Ради України «Про встановлення порядку обчислення часу на території України» (реєстр. № 9121 21.09.2018). Внесені рекомендації.

Description: Legal framework for calculating time in the territory of Ukraine was analized. Expert evaluation is provided on draft resolution of the Verkhovna Rada of Ukraine “On Establishing the Procedure of Time Calculation in the Territory of Ukraine” (registry No. 9121 09/21/2018). It was established that economic, labor-related, physical aspects of this issue were researched by M.V. Kazantsev, R.R.Yarullin, Y.S. Yatskiv and others. Major contribution to the development of the problem of was made by the Head Astronomical Observatory of the National Academy of Sciences of Ukraine. At the same time, legal issues in regulating time zones in Ukraine, the form how they are set. It is determined that the procedure for calculating time in the territory of Ukraine is regulated by a by-law normative act – a resolution of the Cabinet of Ministers of Ukraine. At the same time, the problem of calculating time within the territory of Ukraine is connected with the issues of establishing maximum and minimum length of working time, rest, and other conditions of exercising the right to work, which according to Part 3 of Article 45 of the Constitution of Ukraine shall be defined by law. It determined that Cabinet of Ministers of Ukraine Resolution No. 509 dated 13.05.1996 set the time of the second time zone (Kyiv time) in Ukraine with putting the hands in the clock one hour forward on the last Sunday of March at 3 o'clock and 1 hour backwards on the last Sunday in October at 4 o'clock. A single second time zone has been introduced throughout Ukraine de jure. De facto, the second international time zone does not cover the whole, though most of the territory of Ukraine – almost 95%. A small part of the Transcarpathian region is located in the first time zone; Lugansk, part of Donetsk and a small part of Kharkiv and Zaporizhzhya regions – in the third time zone. The territory of Ukraine extends in length more than one hour. It has established that for the EU Member States, it is now mandatory for the EU Member States to move the hands on the clock twice a year: from the end of March to summer time and from the end of October to winter time. Daylight Saving Time starts at 1:00 am on the last Sunday of March and ends at 1:00 am on Greenwich on the last Sunday in October. But since 2021, according to the decision of the European Parliament, the rules on moving hands of the clock to summer and winter time are canceled in the territory of the European Union. This means that each EU Member State has to set a time zone for good in spring 2021. It was concluded that the procedure for calculating time in the territory of Ukraine should be determined by a special law, as indirectly indicated by certain norms of the Constitution of Ukraine. At the same time, given the decisions of the European Parliament, the need to adopt a law is no longer relevant. In this case, however, there is no regulatory norms on norming seasonal and overtime work; beginning and end of working hours in different regions of Ukraine, taking into account astronomical time and time for everyday needs, physical and spiritual rest.
