| Abstract: | У статті розглянуті основи формування тактичного рішення і його структура. При розгляді поняття тактичних рішень акцентується увага на тому, що тактичне рішення є складним вольовим актом. Виходячи зі структури складного вольового акту називаються основні структурні елементи тактичного рішення. Сформовано поняття тактичного рішення в криміналістиці. |
| Description: | The article deals with the fundamentals of the formation of a tactical solution and its structure. When considering the concept of a tactical solution, its features are called. Such features are: a) the usage in the construction of the tactical line of conduct of the person performing investigative (judicial) activity, as well as when choosing and using them the means of criminalistic tactics; b) the focus on the implementation of tactical impact on a certain object by selected means or methods; c) the existence of a purpose, the content of which is connected with obtaining new information about the offense. At the same time, attention is focused on the fact that the tactical solution is a complex volitional act. The peculiarity of the volitional act is the mechanism of its implementation, the basis of which are volitional efforts at all its stages. Based on the structure of a complex volitional act, the article identifies the main structural elements of a tactical solution. The following structural elements of the tactical solution are named: a) analytical; b) synthesizing; c) information; d) organizational; e) operational; f) performance. The presence of each of the listed structural elements is justified by their role in the formation of the decision by the person performing the investigative (judicial) activity. Such an approach in determining the structure of a tactical solution allows us to see the stages of its formation and the most important elements of this process. In the structure of the tactical solution, the objectives are considered, the achievement of which is related to the formulation of the task and the definition of means and methods for its implementation. The article defines the author’s definition of the concept of tactical decision as a complex volitional act that takes place during the investigation and judicial examination of criminal proceedings aimed at choosing the goal of tactical influence and its implementation by selected means and methods. |
