| dc.description | In the article have been disclosed general and particular features in the constitutional process in different countries, identified the main model of changes, taking into account the so-called constitutional identity. Depending on the circumstances, which have become the basis for constitutional reforms, highlighted four main models of the Constitution: 1) the creation of a constitution as a result jf revolution, or ''revolution-based model"; 2) the creation of a constitution after the war victors to the vanquished or "war-based model": 3) a peaceful transition to a new constitution or "model based on the social contract"; 4) the creation of transnational (supranational) of the Constitution or "model based on the international treaty". | uk_UA |
| dc.description.abstract | Розкриваються загальні і особливі риси, притаманні конституційному процесу у різних країнах світу, позначаються основні моделі конституційних змін з урахуванням так званої конституційно ідентичності. В залежності від обставин, які стали підставою для проведення конституційних перетворень, виділено чотири основні моделі створення конституції: 1) створення конституції внаслідок революції або "модель на революційній основі"; 2) створення конституції після закінчення війни переможцями для переможених або "модель на військовій основі"; 3) мирний перехід до нової конституції або "модель на основі суспільного договору"; 4) створення транснаціональної (наддержавної) конституції або "модель на основі міжнародного договору".
