Abstract
В статье рассматривается дискуссионный в теории уголовного права вопрос о формах и видах соучастия, поскольку среди ученых нет единства в терминологическом обозначении указанных понятий. Действующий УК Украины не содержит понятие формы соучастия и его определения. На основании этимологического значения и философского понимания, с учетом мнения правоведов проводится разграничение этих понятий. Осуществляется анализ юридической литературы, законодательства зарубежных стран. Сформулирована авторская позиция касаемо критериев разграничения и обозначения смежных категорий: форм и видов соучастия, а также видов соучастников.
Description
In the article is examined the debatable question in the theory of criminal law about forms and types of participation, as among scientists there is not unity in terminological denotation of the indicated concepts. Operating CC of Ukraine does not contain the concept of form of participation and his determination On the basis of etymologic value and philosophical understanding, taking into account opinion of legists, differentiation of these concepts is conducted. The analysis of legal literature, legislation of foreign countries comes true. Authorial position is set forth in relation to the criteria of differentiation and denotation of contiguous categories: forms and types of participation, and also types of accomplices.
