До визначення головних ознак декларації як джерела права

Abstract

Статья посвящена исследованию проблем концепции источников права, а именно определению понятия декларации и выяснению ее места в системе источников права. Акцентируется внимание на понимании декларации как источника права в наиболее важном аспекте — как нормативно-правовой акт. В поддержку этого утверждения исследуются признаки нормативно-правового акта как источника права, обосновывается их приемлемость по отношению к декларации. Кроме того, исследуются собственные специфические черты декларации как источника права. С точки зрения подходов к пониманию источников права делается попытка определения понятия декларации.The article deals with the problems of the concept of sources of law, namely the definition of a declaration and clarification of its place in the sources of law. The Declaration is considered in terms of approaches to understanding the sources of law. Focuses on understanding the declaration in terms of a formal approach, this source of law is considered the most important aspect — as a legal act. In support of this assertion, we investigate signs of a regulatory act as a source of law, justifies their acceptability with respect to the declaration. It also investigates its own specific features of the Declaration as a source of law. In terms of approaches to understanding the sources of law is an attempt to define the concept of the declaration.
