Abstract

Исследована проблема разделения властей, разрешение которой гарантировало бы единство государства и обеспечило бы эффективную работу всего государственного механизма, охраняющего права и свободы человека и гражданина в конкретной стране в определенную историческую эпоху. Проанализированы основные подходы к решению вопроса о выделении дополнительных, кроме законодательной, исполнительной и судебной, ветвей власти.In many countries the principle of separation of powers is embodied differently. The reasons of such difference may be a political situation, in which embodiment of mentioned above principle, subjectivism of officials responsible for embodiment of the principle of separation of powers, historical, religious and national peculiarities, etc. take place. In the present article the author analyzes the peculiarities of the embodiment of the principle of separation of powers basing himself on the existing in the scientific literature classification of the forms of government. A lot of attention is paid to the head of the state because of the majority of modern states he is actually out of the system of the separation of powers, out of traditional triad.
