Description
The problem of unconsciousness during the committing of a crime has not been studied in the literature a lot. In the article, attention is focused on the issue of committing a crime in the deep physiological intoxication. The author finds a solution based on the principle «actio libera in causa». This makes it possible to assert that in this case there is a guilt of the person in the form of intent or negligence, connected with the time of bringing person himself into the unconscious state. Legislative amendments regarding a special new rule are proposed.
