Контроль та моніторинг трудових і підприємницьких прав ветеранів війни як дослідницький процес

Abstract

Актуалізація проблеми контролю та моніторингу трудових і підприємницьких прав ветеранів війни обумовлена необхідністю вдосконалення умов їх реалізації. Розглянуто окремі елементи системі функціонування механізму адаптації ветеранів до цивільного життя під час відновлення. Обґрунтовано доцільність інтеграції моніторингу та контролю трудо-правового механізму адаптації задля корекції його елементів. Запропоновано корективи щодо досягнення балансу застосування інструментів та можливостей здійснення державного та недержавного контролю, аудиту, самоконтролю, інших форм соціального моніторингу. Зроблено акцент на недоліках законодавчої бази для реалізації права на підприємницьку діяльність ветеранів війни.Problem setting. The actualization of the problem of control and monitoring of the labor and entrepreneurial rights of war veterans is driven by the need to improve the conditions for their realization. The purpose of this article. The purpose of the article is to highlight the achievements of the research process regarding the creative idea of revealing the problem of ensuring control and monitoring in the system of functioning of the adaptation mechanism for the implementation of labor and entrepreneurial rights of war veterans, as well as – to present the results of the study of a promising direction for improving the provisions of Ukrainian legislation on war veterans. Article’s main body. Specific elements of the functional system of the mechanism for veterans’ adaptation to civilian life during the recovery period are considered. The feasibility of integrating monitoring and control into the labor-legal adaptation mechanism in order to correct its elements is substantiated. Corrections are proposed to achieve a balance in the use of tools and opportunities for state and non-state control, audit, self-control, and other forms of social monitoring. Emphasis is placed on the shortcomings of the legislative framework for the implementation of the right to entrepreneurial activity of war veterans. A comprehensive analysis of the legal status of war veterans in the field of labor and entrepreneurship showed the insufficiency of modern knowledge in the research process of relevant problems, as well as the presence of gaps. Conclusions. It is proposed to create a system for monitoring the effectiveness of ensuring veterans’ rights; to conduct regular assessments of the impact on the development of veteran entrepreneurship; and to amend the requirements for monitoring compliance with the relevant requirements.
