Abstract
Description
The concept of «anomalous affect» which occurs when a person with a mental disorder commits a crime during physiological affect is considered for the first time in the criminal law aspect. Attention is drawn to the fact that articles in which the possibility of physiological affect regarding this category of people is generally denied appeared. This view is reasonably criticized by the author with reliance on the data of psychology and psychiatry and the judicial practice of the Supreme Court of Ukraine.
