Abstract
Анализируется институт замены сторон в обязательстве: основания замены кредитора и должника в нем, ограничения относительно замены кредитора, порядок замены кредитора и должника, соотношение норм Гражданского кодекса Украины об уступке права требования и норм, регулирующих отдельные виды договоров. Исследуется правовая природа перевода долга.
Description
The Substitution of Persons in an Obligation institution is analyzed in the article notably the grounds of the Substitution of Creditor and of Debtor in an Obligation, the Rights, Which May not Be Passed to the Other Persons, the order of the Substitution of Creditor and of Debtor in an Obligation. Correlation of rules of the Civil Code of Ukraine concerning the Transfer of the Creditor's Rights to Another Person and those which regulate particular kinds of obligations are analyzed. The law nature of the Transfer of the Debt is investigated.
