Abstract
Стаття присвячена дослідженню інституту місцевого самоврядування в світлі міжнародних стандартів, закріплених в Європейській хартії місцевого самоврядування. Визначені основні вимоги Хартії до регулювання відносин у сфері формування і здійснення компетенції муніципальних органів, її розмежування із компетенцією органів державної влади, а також європейські стандарти у сфері делегування повноважень. Проаналізовано відповідність українського законодавства цим вимогам, окреслені заходи правового характеру, необхідні для належної імплементації міжнародних стандартів.
Description
Local self‑government is a dynamically changing institution, despite the fact that it has established European traditions of its development. In European countries municipal reforms are carried out in varying degrees and stress transformations in both systemic‑structural and functional and competence fields. The main tasks of such reforms are modernizing the management system at the territorial level by enhancing the ability to respond to changing needs of the population and to ensuring the socio‑economic growth of the territories effectively. Recent research and publications analysis. The constitutional modernization processes in Ukraine increase the relevance of further researches of local self ‑government, its European standards, particularly, relating to competence. Paper objective is to analyze the state of compliance of legal regulation, including project‑constitutional regulation of the competence of local selfgovernment in Ukraine with European legal standards and municipal practice.
