Abstract
This academic article provides a comprehensive theoretical and practical analysis of the Supreme Court’s latest legal position regarding the criteria for assessing, verifying the validity, integrity, and immutability of electronic evidence in civil proceedings (using the example of the Supreme Court’s Civil Chamber ruling of February 4, 2026, in Case No. 758/14925/23). The relevance of the chosen topic stems from the rapid digitization of civil transactions, particularly the widespread shift by business entities (microfinance organizations, banks) toward concluding loan agreements online using electronic signatures with one-time identifiers (via SMS codes or other authorization algorithms). The article analyzes that despite the legislature’s recognition of the legal validity of electronic transactions, the absence of cryptographic protection (which is inherent in a qualified or advanced electronic signature) creates a presumption of the document’s technical vulnerability to unilateral changes. The procedural nature of electronic evidence is examined, and the concepts of the original and the paper copy of an electronic document are distinguished. It has been established that the submission of electronic evidence in a paper copy does not automatically render it inadmissible; however, in the event of reasonable doubts raised by the opposing party, the court is obligated to request the original in electronic form to ensure compliance with the adversarial principle. The author provides a detailed explanation of the procedural algorithm proposed by the Supreme Court for a judge’s actions in the event of a challenge to an electronic contract signed with a one-time identifier. In particular, emphasis is placed on the need to verify metadata, the methods of sending the document (providing a simple link to a webpage or sending an attached PDF file via email), as well as engaging specialists or ordering a computer-technical examination to inspect the information and communication system. It is concluded that the new judicial practice imposes a heightened standard of proof on the creditor, who is obligated to prove both the fact of generating a one-time identifier as well as the immutability of the contract terms from the moment of its acceptance by the consumer. The results of the study can be used by judges, attorneys, and scholars to improve mechanisms for collecting, examining, and evaluating electronic evidence.
