Науково-практичний коментар до ст. 20 «Обмежена осудність» Кримінального кодексу України

Abstract

The article is devoted to the scientific and practical commentary to Art. 20 of the Criminal Code of Ukraine «Diminished sanity». The formula of diminished sanity is studied; the correlation of diminished sanity with sanity, insanity, and guilt is analyzed; the criminal-law consequences of a recognition of a person as a limited condemned are considered. The expert decisions of forensic psychiatric examinations in Ukraine for 2002-2005, as well as the practice of applying Art. 20 of the Criminal Code of Ukraine by local, appellate courts and the Supreme Court of Ukraine were noted.
