Abstract
Стаття присвячена дослідженню нагляду за додержанням органами місцевого самоврядування Конституції та законів України крізь призму історичного досвіду та євроінтеграційних вимог. Здійснено ретроспективний аналіз законодавства України, починаючи з моменту проголошення незалежності, коли Україна успадкувала від УРСР загальнонаглядову функцію прокуратури як домінуючу форму контролю за законністю. Простежено поступовий відступ від цієї моделі під впливом резолюцій і висновків Парламентської Асамблеї Ради Європи, зокрема Висновку № 190 (1995) та Резолюції № 1262 (2001), конституційних змін 1996 та 2016 років, а також прийняття Закону України «Про прокуратуру» 2014 року. Констатовано, що остаточна відмова від загального нагляду прокуратури призвела до утворення правової прогалини: наразі відсутній орган, уповноважений зупиняти дію рішень органів місцевого самоврядування з мотивів їх невідповідності Конституції чи законам України з одночасним зверненням до суду, як це передбачено частиною 2 статті 144 Конституції України. Також, увага акцентується на тому, що законодавець не розмежовує поняття державного нагляду і контролю, хоча за своєю суттю вони суттєво відрізняються як за формою здійснення, так і за колом суб’єктів та характером повноважень. Розглянуто міжнародні стандарти адміністративного нагляду, закріплені у статті 8 Європейської хартії місцевого самоврядування та деталізовані в Рекомендаціях Комітету Міністрів Ради Європи R(98)12 і CM/Rec(2019)3. Висвітлено еволюцію підходів: від мінімальних гарантій проти надмірного втручання держави до позитивної моделі наглядової системи, заснованої на принципах законності, пропорційності та субсидіарності, із запровадженням консультативної функції наглядових органів та превентивних механізмів внутрішнього контролю. Проаналізовано зовнішні нормативні зобов’язання України у цій сфері, що випливають з Угоди про асоціацію з Європейським Союзом, Регламенту (ЄС) 2024/792, яким запроваджено програму Ukraine Facility, та Enlargement Package 2024 року. Наголошується, що запровадження належної пропорційної системи адміністративного нагляду є одночасно юридичним зобов’язанням, умовою отримання фінансової допомоги та публічно верифікованим індикатором євроінтеграційного прогресу України.
The article examines supervision over local self-government bodies’ compliance with the Constitution and laws of Ukraine through the lens of historical experience and European integration requirements. A retrospective analysis of Ukrainian legislation is carried out, tracing developments from the moment of independence, when Ukraine inherited the general supervisory function of the prosecutor’s office from the Soviet system as the dominant form of legality control. The gradual departure from this model is examined considering the Parliamentary Assembly of the Council of Europe’s Opinion No. 190 (1995) and Resolution No. 1262 (2001), the constitutional amendments of 1996 and 2016, and the adoption of the Law of Ukraine «On the Prosecutor’s Office» in 2014. It is established that the final abolition of the prosecutor’s general supervision created a legal gap: there is currently no body authorised to suspend decisions of local self-government bodies on the grounds of non-compliance with the Constitution or laws of Ukraine while simultaneously applying to a court, as required by Article 144(2) of the Constitution of Ukraine. The article emphasises that the legislator fails to distinguish between the concepts of state supervision and control, despite their substantially different legal nature in terms of form, scope of subjects and character of powers. International standards of administrative supervision enshrined in Article 8 of the European Charter of Local SelfGovernment and elaborated in Committee of Ministers Recommendations R(98)12 and CM/Rec(2019)3 are analysed in detail. The evolution from minimum guarantees against excessive state interference to a positive model of a supervisory system based on the principles of legality, proportionality and subsidiarity is outlined, including the introduction of an advisory function for supervisory bodies and preventive internal control mechanisms. Ukraine’s external normative obligations in this field arising from the Association Agreement with the EU, Regulation (EU) 2024/792 establishing the Ukraine Facility programme, and the 2024 Enlargement Package are analysed. It is stressed that establishing a proper proportionate system of administrative supervision simultaneously constitutes a legal obligation, a condition for receiving financial assistance, and a publicly verifiable benchmark of Ukraine’s European integration progress.
