The article reveals the essence and content of the category of judicial discretion, determines the nature of the discretionary powers of the court of first instance, the grounds of application of the court discretion; proposes the author’s classification of the grounds of judicial discretion. Also notices the problem of limiting judicial discretion, criteria for setting such limits, and their specific types.
