Інноваційні методи та цифрові технології документування воєнних злочинів проти культурної спадщини України

Abstract

Cтаття присвячена дослідженню можливостей використання цифрових технологій і інновацій в діяльності правоохоронних органів щодо захисту культури та культурної спадщини України в умовах воєнного стану і повоєнного відновлення країни. Метою дослідження є сформувати відповідний рівень знань для фахового документування випадків руйнувань та пошкоджень культурних цінностей унаслідок збройного конфлікту — як для фіксування та обліку цих фактів, так і для підсилення спроможностей уповноважених органів та їхніх представників під час розслідування та встановлення фактів порушення норм міжнародного гуманітарного права. Розглянуто можливості таких технологій в діяльності як в процесі превентивної діяльності правоохоронних та інших органів злочинам у сфері охорони об'єктів культурної спадщини, так і під час документування і досудового розслідування воєнних кримінальних правопорушень. Передусім, завдяки цим технологіям розширяються можливості оперативного отримання та документування інформації про правопорушення, надаються можливості подальшого збирання доказової інформації та утворюються підстави наступного винних осіб до відповідальності. На основі аналізу світового досвіду у нормах міжнародного гуманітарного права щодо захисту культурних цінностей, прикладів впровадження новітніх цифрових технологій і систем в правоохоронну і правозахисну діяльність, результатів профільних наукових досліджень запропоновано системний підхід до впровадження передових цифрових технологій і інновацій в діяльність правоохоронних органів щодо захисту культури та культурної спадщини України. В роботі приділяється увага питанню взаємодії між правоохоронними органами та військовими силами в умовах воєнного стану, а також проблемі дезінформації в соціальних мережах та інформаційному просторі. Автор дотримується позиції щодо необхідності широкої імплементації в національне, зокрема кримінальне законодавство України норм міжнародного гуманітарного права та міжнародного права охорони культурних цінностей. Також, вельми потрібним є підвищення якості національних розслідувань воєнних злочинів, документування воєнних злочинів, створення доказової бази, що дасть змогу ефективно відстоювати інтереси України як у міжнародних судах, так і здійснювати правосуддя на національному рівні.The article is devoted to the study of the possibilities of using digital technologies and innovations in the activities of law enforcement agencies regarding the protection of culture and cultural heritage of Ukraine in the conditions of martial law and post-war reconstruction of the country. The purpose of the study is to form an appropriate level of knowledge for professional documentation of cases of destruction and damage to cultural values as a result of armed conflict - both for recording and accounting for these facts, and for strengthening the capabilities of authorized bodies and their representatives during the investigation and establishment of facts of violations of international humanitarian law. The possibilities of such technologies in the activity both in the process of preventive activities of law enforcement and other bodies in the field of protection of cultural heritage objects, and during the documentation and pre-trial investigation of war criminal offenses are considered. First of all, thanks to these technologies, the possibilities of quickly obtaining and documenting information about offenses are expanded, the possibilities of further collection of evidentiary information are provided, and the grounds for the next guilty parties to be held accountable are formed. Based on the analysis of world experience in the norms of international humanitarian law regarding the protection of cultural values, examples of the implementation of the latest digital technologies and systems in law enforcement and human rights protection activities, the results of specialized scientific research, a systematic approach to the implementation of advanced digital technologies and innovations in the activities of law enforcement agencies regarding the protection of culture and cultural heritage of Ukraine is proposed. The work pays attention to the issue of interaction between law enforcement agencies and military forces in the conditions of martial law, as well as the problem of disinformation in social networks and the information space. The author adheres to the position regarding the need for wide implementation of the norms of international humanitarian law and international law on the protection of cultural values into the national, in particular criminal legislation of Ukraine. Also, it is very necessary to improve the quality of national investigations of war crimes, document war crimes, create an evidence base that will make it possible to effectively defend Ukraine's interests both in international courts and to administer justice at the national level.
