Abstract: У статті з позицій соціального детермінізму розглянуто питання детермінації злочинності взагалі і сучасної корпоративної злочинності зокрема. Визначено детермінаційні рівні і комплекси корпоративної злочинності. Окреслено перспективи і напрями досліджень обумовленості корпоративної злочинності.
В статье с позиций социального детерминизма рассмотрен вопрос детерминации преступности в целом и современной корпоративной преступности в частности. Определены детерминационные уровни и комплексы корпоративной преступности. Высветлены перспективы и направления исследования причинности корпоративной преступности.
Description: From the point of social determination, the article deals with determination of crime in general and current corporate crime in particular. Determining levels and complexes of corporate crime have been identified. Future research on corporate crime are highlighted. It is mentioned that corporate crime, mostly of big enterprises that have large assets in their turnover, can potentially cause more damage to the society than majority of other types of crime. Foreign scholars highlight an extremely high “price” of corporate crime and mention that these crimes altogether cause more damage than violent and profit-motivated crimes. In earlier works corporate crime was not addressed as an independent phenomenon. It was considered as a partial and quite rare manifestation of crime which can be seen in capitalist economy. That is why determination complexes of corporate crime were not researched. In the understanding of national criminal law the factors, which were found and described, were not as independent as the categories of criminality in the economic sphere. The definition “corporate crime” covers all crimes committed on behalf and (or) in favor of corporate body. This activity is carried out by individuals, who exercise their rights and perform duties of corporate body, or other employees who act within their competence. At the same time criminal liability is possible for both criminal body and individual. Determining complexes are divided into economic, social, moral, psychological, negative, organizational, managerial and other criminogenic factor complexes. Special attention is drawn to social and collective determinants. These factors are always essential within the entire criminality but their determining influence on corporate crime is successfully disguised. It can be explained by the fact that these factors exist out of the mechanism of economic activity of corporations. There are preconditions to think that the activity of corporations makes the sphere and everyday life of people. It can be an aggressive and imperative commercial “buy or you are not in trend”, propaganda “consumption for consumption” etc. The article deals with each determining complex. The conclusion about necessity to resolve further issues of corporate crime has been drawn.
