| Abstract: | Стаття присвячена теоретичному аналізу принципу єдиного громадянства, дослідженню його закріплення в законодавстві України і зарубіжних країн. Розглядається категорія множинного громадянства, наводяться аргументи «за» та «проти» подвійного громадянства. Окремо аналізуються внутрішньодержавні та міжнародно-правові способи запобігання подвійному громадянству, вироблені світовою практикою, їх закріплення в законодавстві України. Статья посвящена анализу принципа единого гражданства, исследованию его закрепления в законодательстве Украины и зарубежных стран. Рассматривается категория множественного гражданства, аргументируются доводы «за» и «против» двойного гражданства. Отдельно анализируются внутригосударственные и международно-правовые способы предотвращения двойного гражданства, выработанные мировой практикой, их закрепление в законодательстве Украины. |
| Description: | Work is devoted the theoretical analysis of principle of single citizenship, research of his fixing in the legislation of Ukraine and foreign countries. Two aspects of principle of single citizenship are examined in the article. One of these aspects of principle of single citizenship is related to such phenomenon, as bipatrizm, that supposes a presence at a person simultaneously citizenships two and more than the states. The special attention is in-process spared the analysis of this aspect of principle of single citizenship. The category of plural citizenship is examined in the article, reasons of origin are probed at the face of citizenship two and more than the states. The work analyzes relationship of different states to dual citizenship, reasons are in-process argued «pro and con» dual citizenship. Domestic and international legal methods are separately examined preventions of dual citizenship, among which are the following: ground for the loss of Ukrainian citizenship is voluntary purchase of an adult citizen of Ukrainian citizenship of another country; enshrines the principle of the impossibility of automatic acquisition of nationality by marriage to a citizen of Ukraine. When you purchase a foreigner Ukrainian nationality from such person is required to file the obligation to terminate foreign citizenship. This requirement is also aimed at implementing the principle of common citizenship. The article also states that the existence of dual citizenship in Ukraine is allowed if one has been purchased, not willingly, then there is not the will of a person while purchasing a second citizenship. This work contains a number of proposals to improve the legislation on citizenship in Ukraine. |
