| Abstract: | В статье рассматривается иерархичность как признак наиболее опасной формы соучастия – преступной организации. В УК Украины отсутствует законодательное определение понятия иерархичности, что создает сложности для следователей, прокуроров, суда при определении наличия или отсутствия этого признака при совершении преступления преступной организацией. Наводиться этимологическое значение понятия «иерархичность», анализируются мнения ученых по поводу установления содержания этого термина. Осуществляется анализ юридической литературы, постановлений Пленума Верховного Суда Украины и отдельных международно-правовых актов. Сформулирована авторская дефиниция понятия иерархичности и критерии ее оценивания. |
| Description: | The article considers the hierarchy as a sign of the most dangerous forms of complicity – a criminal organization. In the Criminal Code of Ukraine is no legal definition of the hierarchy, making it difficult for investigators, prosecutors, judges in determining the presence or absence of this feature in the commission of a crime by a criminal organization. Induced etymological meaning of "hierarchy", analyzes the opinions of scholars concerning the introduction of the term of detention. Carried out an analysis of the legal literature, decisions of the Supreme Court of Ukraine and some international legal documents. The author's definition of the notion of hierarchy and the criteria for its evaluation. |
