| Abstract: | Статья посвящена рассмотрению вопроса о возникновении и развитии института добрососедства в земельном праве, начиная со времен Древнего Рима. Актуальность темы обусловлена тем, что данный институт пребывает на стадии формирования и развития. Положения законодательства, регулирующие рассматриваемые отношения, нормативно установлены ограничениями прав на землю, имеющими целью обеспечить справедливый баланс интересов владельцев (пользователей) соседних землевладений. |
| Description: | This article is devoted to consideration of questions on occurrence and development of neighborliness in the land law, since times of the Ancient Rome. The theme urgency is caused by the fact that the neighborliness in the Ukrainian legislation stays at a formation and development stage. Positions of the legislation, which regulate the given relations, are normatively set limitations which have a purpose to provide fair balance of interests of owners (users) of the next landed properties. |
