| Abstract: | Основываясь на методологии теории систем и сравнительно-правовом анализе организации и функционировании судебных систем разных стран, автор выделяет сущностные признаки 4-х типов судебных систем: романского, германского, английского и смешанного. В качестве критериев типологии использовались: структура и виды судов, судебный режим, модель специализации, принципы судоустройства, наличие несудебных органов и их компетенция. |
| Description: | On the basis of methodologies of the theories of the systems and relatively-legal analysis of organization and functioning of judicial systems of the different countries the author, has allocated intrinsic attributes of 4 types of judicial systems: Romance; German; English and mixed. As criterion to typologies were used: Structure and types of courts, judicial mode, model of specialization, principles judiciary, presence of non judicial organ and their competence. |
