Abstract: Стаття присвячена доказовій діяльності на стадіях розгляду справи в порядку адміністративного судочинства. Особливу увагу приділено виокремленню стадій розгляду справи, які незмінні для всіх інстанцій і можуть бути зведені за результатами аналізу положень КАСУ до таких: 1) підготовче провадження; 2) попередній розгляд справи; 3) судовий розгляд справи; 4) ухвалення судового рішення у справі.
Статья посвящена доказательной деятельности на стадиях рассмотрения дела в порядке административного судопроизводства. Особое внимание уделено стадиям рассмотрения дела, которые являются неизменными для всех инстанций и могут быть сведены по результатам анализа положений КАСУ к следующим: 1) подготовительное производство; 2) предварительное рассмотрение дела; 3) судебное разбирательство; 4) принятие судебного решения по делу.
Description: The article is devoted to evidence-based activities at stages of the proceedings in the administrative proceedings. Particular attention is paid to the provision out stages of the proceedings, which is constant for all levels and can be kept on the analysis of the provisions of the CSSA to the following: 1) preparatory proceedings, 2) preliminary hearing, and 3) trial, 4) the adjudication of the case Evidence based activities administrative proceedings is ordered in nature, carried out throughout the proceedings and may be structured by selection of certain stages. The immediate objective of the preparatory phase is to provide in a timely manner at the first hearing thorough, complete and objective solving court legal question referred to it by the expressed in a particular administrative case. However, especially in the preparatory stage of the proceedings the court activism should promote conciliation in order to save time and opportunity did not hear the case. Mandatory preparatory proceedings predetermined as court decisions, namely: 1) the abandonment of the claim without consideration, 2) suspension of proceedings, 3) closing the proceedings, and 4) completion of the preparatory proceedings and the appointment of a case for trial. Activity in the preliminary court proceedings appears as follows: 1 ) to settle a dispute the court ascertain whether the claimant refuses to administrative action if the defendant does not recognize administrative claim, and explain to the parties the possibility to reconcile (p. 112 CSSA). At the request of the parties the court suspends the proceedings at the time they need for reconciliation (Part 2 of Art . 113 CSSA), 2) clarify the claims and objections of the defendant against the administrative claim, and 3) clarifies the composition of individuals participating the case, and 4) determine the facts to be established to resolve the dispute and which are recognized by the parties that belongs to prove, 5) clarifies what evidence the parties may justify their arguments and objections , and sets deadlines for their delivery. Also, the main purpose of pre- trial meeting is to discuss the judge of the trial participants all factual and legal circumstances. Consideration of the merits made by sequential Done – of court actors and complex proceedings that constitute certain stages, each of which has its own objectives and relevant content. Addressing the court on the merits of the dispute ends with a judicial decision in the form of regulations (Part 1 of Art. 158 CSSA). The main precondition for the adoption of legal and justified the judgment is to establish facts of the case – a certain range of facts from which the law binds the legal consequences.
